1. Agreement to Terms
Motion Training Collective
Terms of Service
These Terms of Service ("Terms") constitute a legally binding agreement between you and SB Fitness Partners, LLC (DBA Motion Training Collective), located at 918 Chapala St, Santa Barbara, CA 93101. By enrolling in membership, purchasing services, or using our facilities, you agree to be bound by these Terms.
2. Services Offered
Motion Training Collective offers the following services:
• Unlimited Membership: Provides access to unlimited group fitness classes as scheduled.
• Punch Cards: Pre-purchased class packages allowing access to a set number of group fitness classes.
• Personal Training: One-on-one coaching sessions scheduled directly with a coach.
Class schedules, availability, and service offerings are subject to change at our discretion. We will make reasonable efforts to communicate changes in advance.
3. Membership and Billing
3.1 Auto-Renewal
Unlimited memberships are billed on a monthly basis and automatically renew each month unless canceled in accordance with Section 4 of these Terms. By enrolling in a membership, you authorize us to charge your payment method on file on a recurring monthly basis.
3.2 Payment
You agree to maintain a valid payment method on file. You are responsible for ensuring your billing information is current and accurate. We reserve the right to suspend or terminate membership access in the event of a failed payment.
3.3 Price Changes
We reserve the right to adjust membership pricing. We will provide at least 30 days' written notice of any price changes prior to the next billing cycle.
4. Cancellation Policy
To cancel your membership, you must notify us at least 7 days before your next billing date by:
• Emailing us at motioncollectivesb@gmail.com
• Providing written notice in person at our facility
Cancellations received less than 7 days before the next billing date may result in one final charge for the upcoming billing cycle. Membership access will continue through the end of the paid period.
Punch cards and personal training sessions are non-refundable once purchased. Unused punch card sessions expire 12 months from the date of purchase.
5. Refund Policy
Monthly membership fees that have already been charged are generally non-refundable. Exceptions may be made at our sole discretion in cases of documented medical emergencies or extenuating circumstances. All refund requests must be submitted in writing to motioncollectivesb@gmail.com and will be reviewed on a case-by-case basis.
6. Membership Pause / Freeze Policy
Members with an active unlimited membership may pause their membership subject to the following conditions:
• Pauses must be a minimum of 10 consecutive days in duration.
• Members may pause their membership no more than two (2) times per calendar year.
• Pause requests must be submitted in advance by contacting us at motioncollectivesb@gmail.com.
• Billing will be prorated or paused accordingly during an approved freeze period.
Pauses of fewer than 10 days are not permitted. Punch card memberships and personal training packages are not eligible for pause.
7. Liability Waiver
ACTIVITY WAIVER FORM
THIS ACTIVITY WAIVER FORM (this "Waiver") dated this _______ day of ____________________, __________.
IN CONSIDERATION of being allowed to participate in the Activity and other good and valuable consideration, the receipt of which is hereby acknowledged, I ___________________________ of ________________________________________ (the "Participant") agree with SB Fitness Partners LLC of 918 Chapala St, Santa Barbara, CA 93101, USA (the "Activity Provider") to the following:
DETAILS OF ACTIVITY
1. The Participant will be participating in the following activity: Fitness classes and open gym at Motion Training Collective (the "Activity") provided by the Activity Provider.
CONSIDERATION
2. Being of lawful age and in consideration of being permitted to participate in the Activity, the Participant
releases and forever discharges the Activity Provider, its owners, directors, officers, employees, agents, assigns, legal representatives, and successors from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation in the Activity, and not withstanding that such damage, loss, or injury may have been caused solely or partly by the negligence of the Activity Provider.
3. The Participant understands that the Participant would not be permitted to participate in the Activity unless the Participant signed this Waiver.
CONCURRENT RELEASE
4. The Participant acknowledges that this Waiver is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant by the Activity Provider, and with the intention of binding the Participant's spouse, heirs, executors, administrators, legal representatives, and assigns.
FITNESS TO PARTICIPATE
5. The Participant acknowledges to the Activity Provider that the Participant does not have any physical limitations, medical ailments, or physical or mental disabilities that would limit or prevent the Participant from participating in the Activity. If required, the Participant will obtain a medical examination and clearance.
FULL AND FINAL SETTLEMENT
6. The Participant acknowledges and agrees with the Activity Provider that: (1) the Activity Provider has given the Participant sufficient time to carefully read this Waiver, (2) the Participant has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Waiver, (3) the Participant fully understands the risks and claims that the Participant is waiving to participate in the Activity, (4) the Participant is freely and voluntarily executing this Waiver, and (5) the Participant is forever prevented from suing or otherwise claiming against the Activity Provider for any property loss or personal injury that the Participant may sustain while participating in or preparing for the Activity.
GOVERNING LAW
7. This Waiver will be governed by and construed in accordance with the laws of the State of California.

By signing up for membership or using our facilities, you acknowledge that you have read, understood, and agreed to the liability waiver provided at enrollment.
8. Member Code of Conduct
Motion Training Collective is committed to maintaining a safe, welcoming, and respectful environment for all members and coaches. As a condition of membership, you agree to conduct yourself in a manner
consistent with these values at all times.
We reserve the right to suspend or terminate membership, without refund, for any of the following:
• Crude, offensive, or inappropriate behavior directed at members, coaches, or staff
• Creating a hostile, threatening, or unsafe environment for others
• Disrespect toward coaches, fellow members, or the physical facility
• Failure to pay membership dues or outstanding balances
• Any behavior that is harmful, disruptive, or disrespectful to our business or fitness community
We reserve the right to refuse service to any individual at our sole discretion. Membership terminations for conduct violations are not eligible for refunds.
9. Age Requirements
There is no minimum age requirement for membership at this time. However, members under the age of 18 must have a parent or legal guardian sign all enrollment documents and liability waivers on their behalf.
10. Facility Rules
Members are expected to treat the facility with care and respect. This includes but is not limited to:
• Re-racking weights and returning equipment to its designated location after use
• Maintaining personal hygiene appropriate for a shared fitness environment
• Following coach instructions during classes
• Not recording others without their consent
11. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email or posted notice at least 14 days before taking effect. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising under these Terms shall be resolved in the courts of Santa Barbara County, California.
